By creating an account, accessing, or using the "Electric Astrology" application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms are a binding legal agreement between you and Planetary Logic Controls LLC ("Company," "we," or "us").
2. NO MEDICAL ADVICE
THE SERVICE IS FOR EDUCATIONAL AND ENTERTAINMENT PURPOSES ONLY. THE SERVICE, INCLUDING THE "ELECTRIC STRESS SCORE," "VOLTAGE" METRICS, AND LIFESTYLE SUGGESTIONS, DOES NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. THE SERVICE IS NOT A MEDICAL DEVICE AND SHOULD NOT BE USED TO MONITOR OR TREAT ANY MEDICAL CONDITION. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION. IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY, CALL YOUR DOCTOR OR 911 IMMEDIATELY.
3. User License and Intellectual Property
A. Our IP
The Service, including its "Dynamic Cookbook" text, algorithms, code, graphics, and the "Electric Astrology" brand, is the proprietary property of the Company and is protected by copyright, trademark, and other intellectual property laws.
B. Restrictions
You agree not to:
- Use the Service for any illegal purpose.
- Copy, modify, or create derivative works of the Service.
- Use any robot, spider, scraper, or other automated means (including AI or Large Language Models) to access the Service or extract data or content for any purpose.
4. User Data and Aggregation License
You retain ownership of the raw personal data you upload to the Service. However, by using the Service, you grant the Company a worldwide, perpetual, irrevocable, royalty-free license to aggregate, anonymize, and de-identify your data ("Aggregated Data"). You acknowledge and agree that the Company owns all right, title, and interest in and to the Aggregated Data and may use, sell, license, and distribute such Aggregated Data for any purpose, including research and product development, without further compensation to you.
4.1 Research & Commercialization of Psychographics
You acknowledge that the Service collects "Psychometric Data" (Personality Tests). By submitting this data, you grant Planetary Logic Controls LLC the specific right to:
- Anonymize your responses (stripping all personal identifiers).
- License/Sell this anonymized dataset to third parties, including Academic Institutions, Universities, and Research Organizations, for the purpose of behavioral science studies.
Note: You are not entitled to any compensation from the sale or licensing of this anonymized research data.
4.2 Reading Analytics
When you use the Electric Astrology e-reader, the Service automatically collects reading session data, including page navigation events, time spent per chapter, and reading speed patterns. This data is associated with your account and used to improve future editions of the book and the reading platform. Aggregated and anonymized reading analytics may be used for research and product development purposes. You may not disable this collection while using the e-reader.
5. Accounts and Subscriptions
- Registration: You agree to provide accurate, current, and complete information during the registration process.
- Payment: All fees for subscriptions and digital products are non-refundable, except as required by law.
- Termination: We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms.
6. Third-Party Links and Affiliates
The Service may contain links to third-party websites and products. We are a participant in the Amazon Services LLC Associates Program and other affiliate programs. We accept no responsibility for the content, privacy policies, or practices of any third-party websites.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PLANETARY LOGIC CONTROLS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
7.1 Calendar Sync Disclaimer
If you use the "Calendar Sync" feature, you acknowledge that the Service may add, modify, or delete entries in your connected calendar. Planetary Logic Controls LLC is not liable for:
- Any loss of data, missed appointments, or scheduling conflicts resulting from the sync.
- Any technical errors caused by third-party APIs (Google, Apple, Microsoft).
You are solely responsible for backing up your calendar data before enabling this integration.
8. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the State of Tennessee, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Davidson County, Tennessee.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date or by sending you an email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
